I. DEFINITIONS

Terms used in these Terms and Conditions have the following meanings:

  1. (a) Working days - days from Monday to Friday, excluding public holidays.
  2. b) Consumer - a natural person making a legal transaction with a trader which is not directly related to his/her commercial or professional activity.
  3. c) Digital Service - a service enabling the Consumer:
    - creation, processing, storage or access to data in digital form;
    - making available digital data which has been uploaded or created by the Consumer or other users of this service;
    - other forms of interaction with data.
  4. (d) Digital content - data created and delivered in digital form.
  5. e) Order - a completed electronic order form that the user submits to order selected services from the Operator.
  6. f) User - natural person having full legal capacity, using the website Bali-travelcard.com

  8. h) User Information - any data concerning the User or persons represented by the User, provided to the Operator for the purpose of using the services.
  9. i) Service Contract - the contract for the provision of services concluded between the Operator and the User.
  10. j) Services - services provided electronically by the Operator, in particular:
    - processing of the electronic travel permit to Bali (also known as the 'Bali Tourist Levy Card');
    - advisory services and travel assistance.

II. GENERAL PROVISIONS

  1. These Terms and Conditions set out the general terms and conditions and the manner in which the services are to be provided electronically via the website. https://Bali-travelcard.com/.
  2. These Terms and Conditions apply each time you use our website or otherwise access our services. By using our website, you acknowledge that you accept these Terms and Conditions and agree to abide by them.
  3. The regulations are always available at https://Bali-travelcard.com/, which allows it to be downloaded, displayed and saved by printing or saving it to a data carrier at any time.
  4. You are responsible for obtaining internet access and having a compatible device connected to the internet in order to purchase our services. The quality of the use of our services depends on several factors, including your device and the quality of your internet connection. The website can be used if the user's IT equipment meets the following minimum technical requirements: computer or mobile device with internet access, email access, Firefox, Chrome, Safari, Internet Explorer, Opera browser, with cookies and JavaScript enabled.
  5. The Operator informs that the public nature of the Internet and the use of services provided electronically may involve the risk of user data being intercepted and modified by unauthorised persons, and users should therefore use appropriate technical measures to minimise these risks, such as anti-virus software.
  6. The User acknowledges that 100% service availability is not technically possible. Nevertheless, the Operator will make every effort to ensure that the website and services are as stable as possible.
  7. The operator makes no warranties or representations, express, statutory or implied, concerning the availability of telecommunications services from the provider or access to the services at any time or place, or any loss or damage in connection with the services.
  8. The operator provides advice and assistance in processing and verifying applications for electronic travel permits to Bali via the website.
  9. The operator is an independent service provider and is not affiliated with any government institution. Assistance includes completing and submitting applications for the Bali Tourist Levy Card. The fee for this service includes professional support, application verification and submission, as well as any mandatory government fees.
  10. The operator does not guarantee that the services or content are appropriate or available in all jurisdictions and countries. You are responsible for complying with all applicable laws regarding the use and access of the services in your region.
  11. The Operator warrants that it has all rights and authority necessary to enter into and perform this Agreement.
  12. When using our services, you may not:
  1. reproduce, distribute, sell, create derivative works, decompile, analyse the source code or decompose it into its component parts;
  2. attempt to circumvent any technical measures (including digital rights management) that may be applied by the Operator;
  3. take actions that disrupt or damage our service;
  4. use our service to transmit unlawful, infringing, harmful or otherwise undesirable content;
  5. spam or harass other users or the system;
  6. engage in fraudulent, deceptive or misleading practices;
  7. carry out commercial activities unless expressly permitted by the Operator;
  8. engage in any illegal activity.

III. PROCESSING THE Bali Tourist Levy Card FORM

  1. The operator provides advice and assistance in processing and verifying applications for electronic travel permits to Bali via the website. The service includes: verification of the data provided, further processing and submission of the permit application to the relevant authority in Bali.
  2. The website provides an online form that must be completed in order to obtain a Bali Tourist Levy Card. The form contains questions that need to be answered and the website offers a specialised service to review the answers and information provided before submitting the application. Additional information may be requested and if any inaccuracies are found, the processing of the application may be delayed.
  3. Depending on your nationality and personal history, it is possible to qualify for a Bali Tourist Levy Card. In order to be authorised for the Bali Tourist Levy Card, you will need to provide certain information about yourself, your passport and the purpose of your visit to the country. If additional information is required or the application is incomplete, you will be notified by email. Please note that the verification process may cause delays in processing time.
  4. Once the information provided has been positively assessed as adequate and complete, the application will be sent for approval.
  5. Once payment has been received, confirmation of the granting of a travel permit to Bali will be provided as soon as possible (within a maximum of 72 hours).
  6. In the event that the application cannot be processed, the user will be informed and their payment will be refunded. By completing the form, the user agrees to the use of a temporary email address ([email protected]) on the site lovebali.baliprov.go.id for the purpose of processing the application. This address will be stored in the application for the duration of the authorisation to enable the user to be immediately informed of any changes to the Bali Tourist Levy Card. Additionally, the user will receive an email a few days before the authorisation expires. If the user does not agree with this arrangement, they should write to [email protected]. Once the authorisation is approved, the contact email address will be replaced with the user's address.
  7. The Bali Authority's decision to grant or deny the travel authorisation will be communicated to the user and, if approved, the user will receive a confirmation.
  8. If travel authorisation is refused, the decision will be communicated to the user by e-mail. The user is required to provide an e-mail address when filling in the form in order to receive the decision.
  9. The Bali Tourist Levy Card can be issued and sent to you at the earliest seven days prior to your scheduled travel. If a user places an order for a Bali Tourist Levy Card and his/her arrival in Bali is scheduled for a later date, he/she will be informed by email that the document will be issued and sent a minimum of seven days before the scheduled travel date. Processing of such an order will take place seven days prior to the user's scheduled travel, and authorisation will be sent to the email address provided.
  10. It is the user's responsibility to check the accuracy of all data contained in the PDF document provided upon receipt of the Bali travel authorisation. If errors are found, the user should contact the operator immediately. Failure to do so relieves the operator of any liability for any damage suffered by the user as a result of an incorrect or invalid travel authorisation.
  11. It is recommended that all travellers begin the process of applying for the Bali Tourist Levy Card as early as possible, at least seven days before departure, to allow for any unforeseen delays or complications.
  12. Please note that if the user interferes with the process of completing the authorisation on https://lovebali.baliprov.go.id/ after the order has been placed (e.g. by changing the details prior to payment on https://lovebali.baliprov.go.id/ or by making payment independently), the user will not be entitled to a refund of the fee paid on our website, regardless of who initiated the request on https://lovebali.baliprov.go.id/. This provision remains in force even if the user has not formally cancelled the contract before the result is delivered.
  13. If the application is unsuccessful, the applicant can use another provider or apply in person at the relevant BALI government website. The final decision to approve or reject an application for the Bali Tourist Levy Card rests with the Bali Government. In the event of rejection, it is recommended that the applicant contacts the Bali embassy or consulate in their country of residence for advice on the best way to apply for a standard visa.
  14. Each traveller is required to complete all requirements for travel to Bali. Complete and truthful answers to all questions must be provided. If any information is found to be incorrect, you may be denied boarding or denied entry to Bali. In such a case, our company will not be responsible for any additional costs or inconvenience. The user is fully responsible for the accuracy of the information contained in the travel authorisation received.
  15. Despite the correct submission of the online Bali Tourist Levy Card form, this is not a guarantee of entry to Bali. Upon arrival in Bali, the decision to grant entry will be based on an individual assessment. A key element of this assessment is the veracity and accuracy of the information provided by you or on your behalf by an authorised third party.
  16. The service contract is concluded in English.

IV. PRICES / PAYMENTS

  1. Prices for services are expressed in US dollars (USD).
  2. The fee for processing the travel permit and related services is: IDR 150,000 (official price) when converted to dollars at the previous day's exchange rate of the National Bank of Poland, service fee: 50.00 $ (service charge).
  3. Payment can only be made by credit card (VISA or MasterCard). In rare cases and only by prior arrangement, payment by bank transfer is possible.
  4. Clicking the "Pay and Apply". constitutes the user's formal request for selected services and initiates the online credit card payment process. Once the payment operation is completed, the user is informed of the result of the payment transaction and the outcome of the application process. Copies of this information are also sent to the email address provided in the application.
  5. The Operator may periodically change the prices of its services and add new charges for certain features or to adapt to changes in legislation or business strategy. The user will be informed in advance of changes in recurring charges.
  6. The user is obliged to provide correct information regarding his/her credit or debit card. The user represents and warrants that the information provided is correct and that he/she is authorised to use the payment instrument concerned.
  7. Online payments are processed by the system Stripe.
  8. Before making payment, the user will be informed immediately of the amount to be paid, the available payment methods and the details of the payment provider, if the service is available. Detailed terms and conditions for processing payments via electronic payment providers are available on the websites of these providers.
  9. When making a payment via an electronic payment operator, the user should follow the instructions given by the operator in order to complete the transaction correctly.
  10. The user agrees to receive the purchase documents (invoice / receipt) in electronic form.

V. SUPPLY OF DIGITAL CONTENT / SERVICES

  1. The operator shall provide the digital content or digital service to the consumer immediately after the conclusion of the contract, unless otherwise agreed by the parties.
  2. Digital content is considered to be delivered when the user or a physical or virtual device of his/her choice accesses the digital content or the means to download it.
  3. A digital service is deemed to be delivered when the user or a physical or virtual device of the user's choice accesses it.
  4. If the Operator has failed to deliver the digital content or digital service, the consumer may request delivery. If the Operator fails to deliver the digital content or digital service immediately or within an additional period of time expressly agreed by the parties, the consumer may withdraw from the contract.
  5. The consumer may withdraw from the contract without calling for the digital content or digital service if:
    (1) it appears from the Operator's statement or circumstances that the Operator will not provide digital content or a digital service, or
    (2) the consumer and the Operator have agreed, or it is apparent from the circumstances of the conclusion of the contract, that a particular time limit for the delivery of the digital content or digital service was important to the consumer and the Operator did not deliver it within that time limit.
  6. The burden of proof for the provision of digital content or digital service shall lie with the Operator.

VI. REFUND POLICY

  1. The user, who is a Consumer, has the right to withdraw from the contract without stating any reason, by making a declaration to this effect within 14 days in accordance with the applicable legislation.
  2. To comply with the time limit, it is sufficient for the Consumer to make a statement before the time limit expires.
  3. The declaration of withdrawal can be sent to the Operator's e-mail address: [email protected].
  4. The right of withdrawal from a distance contract does not apply to the Consumer in respect of contracts:
    (a) for the provision of services for which the Consumer is liable to pay the price, if the Operator has performed the service in full with the express and prior consent of the Consumer, who has been informed before the performance of the service that after the performance of the service he will lose his right of withdrawal, and has acknowledged this.

VII. COMPLAINTS

  1. Any User may submit complaints about the Services in writing to the email address: [email protected].
  2. Complaints will be dealt with within 14 days from the date of their receipt by the Operator.
  3. The operator shall comply with the provisions of Chapter 5B of the Consumer Rights Act as regards contracts for the supply of digital content or services.
  4. (For users in the EU) In accordance with Article 14(1)-(2) of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, we are committed to posting information on the ODR platform.
    Online Dispute Resolution (ODR) platform aims to facilitate the independent, out-of-court resolution of disputes between consumers and traders over the internet. These disputes concern contractual obligations arising from sales or service contracts concluded online between consumers resident in the European Union and traders established in the European Union.Link to ODR platform: http://ec.europa.eu/consumers/odr/.

VIII. LIABILITY

  1. The Operator reserves the right to interrupt access to the Services in order to carry out periodic maintenance work or in the event of technical problems, security threats or other circumstances beyond the Operator's control.
  2. The Operator shall not be liable for any damage resulting from the use or inability to use the Services by the User, including in particular damage resulting from:
    • unlawful access to or use of the Service by any person,
    • hacking attacks or similar incidents,
    • force majeure,
    • the acts or omissions of the User, telecommunications operators, providers of telecommunications and energy services.
  3. The Operator is also not liable for the User's lost profits.
  4. The Operator shall not be liable for any damage suffered by the User if the data provided by the User is incomplete, incorrect or omitted, resulting in a negative impact on the application process.
  5. The Operator shall not be liable for any damages that may result from an erroneous decision made by a Bali customs or immigration officer after the User has boarded a plane or ship. In addition, the Operator shall not be liable for any damage resulting from a decision to refuse or revoke a permit to enter Bali. The Operator's liability is limited to the amount paid by the User for the service provided.

IX. ACCESSIBILITY

  1. The operator guarantees the availability of services at 90% time per year. This time does not include periodic maintenance work, which may require a temporary shutdown of the service, as well as interruptions due to force majeure, interference by third parties or other problems beyond the Operator's control.

X. PRIVACY

  1. The Operator collects and processes Users' personal data in accordance with applicable laws and Privacy Policy.
  2. The Operator uses appropriate technical and organisational measures to ensure the protection of the personal data processed.
  3. Additional information on data protection is contained in Privacy Policy.

XI. SEVERABILITY CLAUSE

  1. In the event that any provision of these Terms and Conditions is deemed to be unlawful, void or unenforceable, the provision shall remain enforceable to the maximum extent permitted by applicable law. The unenforceable part shall be deemed separated from these Rules, and such decision shall not affect the validity and enforceability of the remaining provisions.

XII. FORCE MAJEURE

  1. Neither party shall be liable for any failure to perform its obligations arising from the operation of the force majeure, including but not limited to: epidemic, flood, fire, storm, shortage of raw materials, transport strike, partial or total strike, lockout. The party affected by such an event is obliged to inform immediately the other party, but no later than within five (5) working days from the occurrence of the event.
  2. The parties undertake working together to find the best solution enabling the contract to be fulfilled during a situation of force majeure.

XIII. FINAL PROVISIONS

  1. All rights to the Online Service, including copyrights, intellectual property rights to its name, its Internet domain, the website of the Online Service, as well as to its forms and logos, belong to the Operator and may only be used as set out in these Terms and Conditions.
  2. Each user will be informed of amendments to the Rules of Procedure via an announcement on the homepage of the Online Service.
  3. These Regulations are subject to the law of the Republic of Poland. The parties expressly exclude the application of United Nations Convention on Contracts for the International Sale of Goods (CISG).
  4. Choice of law by the parties shall not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country in which the consumer has his permanent residence in the EU.
